Preliminary Article
Atelier Reya International SA (hereinafter referred to as ‘Atelier Reya’) markets Atelier Reya products worldwide.
Keen to better meet its customers’ expectations, Atelier Reya has established, alongside its network of stores, a distance selling and online sales network for some of its products. In accordance with Article L. 221-1, I, 1° of the French Consumer Code, ‘Distance Selling’ refers to any contract concluded between Atelier Reya and a consumer within an organized distance selling system, without the simultaneous presence of the Atelier Reya professional and the consumer, using one or more means of distance communication up to and including the conclusion of the contract.
This network of distance selling and online sales includes distance selling by telephone or email through Atelier Reya’s Distance Selling Service (hereinafter referred to as ‘Distance Selling’). The exchange with the customer begins by telephone and/or email, and the order is placed by email.
E-commerce sales via the Atelier Reya website (hereinafter referred to as ‘Website Sales’). The customer’s order is placed on the Website.
Sales of products to the customer are governed by these general terms and conditions of sale (hereinafter referred to as ‘General Terms and Conditions of Sale’).
These General Terms and Conditions of Sale do not apply to sales in physical stores.
These General Terms and Conditions of Sale apply to both Distance Sales by telephone or email and Sales on the Website. Provisions specific to each sales channel are specified when necessary; other provisions apply to both channels unless otherwise indicated.
The list of Atelier Reya items available for online purchase can be found on the website. For online sales, Atelier Reya has selected a range of items. Any item available online will display a ‘Buy’ button on the relevant product page.
The system in place, which requires an active approach by the customer, complies with the requirements for distance selling, in particular Articles L.221-1 et seq. of the Consumer Code.
For all distance sales, Atelier Reya does not solicit or contact customers by telephone. Consequently, provisions of the French Consumer Code applicable to telephone solicitation at home (Articles L.221-16 and L.221-17) do not apply to transactions governed by these General Terms and Conditions of Sale. Customers may register on the ‘Bloctel’ telephone solicitation opt-out list.
The Distance Selling and Website Sales processes are reserved exclusively for consumers acting solely on their own behalf. A consumer is any natural person who acts for purposes that do not fall within their commercial, industrial, craft, professional, or agricultural activity.
Prior to placing any order, each customer declares they are acting as a consumer and that purchases are for personal needs, not for commercial purposes or resale. They certify they have the legal capacity to enter into a contract and purchase the items, and guarantee the truthfulness and accuracy of the information provided.
Scope
These General Terms and Conditions of Sale apply to all sales of Atelier Reya items concluded with consumers as defined above:
– through the Distance Selling Service set up by Atelier Reya, for delivery to Europe, the Middle East, America, and Africa.
– via the Atelier Reya website, for delivery in metropolitan France.
Any Distance Sale or Website Sale of Atelier Reya items is concluded subject to the prior condition of the express acceptance of these General Terms and Conditions of Sale by the customer.
In accordance with Article 1127-1 of the French Civil Code, these General Terms and Conditions of Sale may be saved by any person visiting the website, either electronically or by downloading a PDF version. They may also be reproduced by the customer by printing them; these General Terms and Conditions of Sale remain applicable as long as they appear on the website.
If, after their modification or removal from the website, these General Terms and Conditions of Sale remain accessible via other websites or by any other means, they will no longer be enforceable against Atelier Reya. Atelier Reya may update and modify these General Terms and Conditions of Sale. The latest version of the General Terms and Conditions of Sale will always be available on the website.
In any event, the conditions applicable to the sale of items are those in force at the time the sale is concluded.

Ordering Items
Orders placed through Distance Selling and Online Sales will be processed according to the following steps:
Distance Selling Orders:
Orders will be received by Atelier Reya’s Distance Selling Department through the available online ordering channels. The customer will provide the necessary information for the order to be processed and shipped correctly.
At the beginning of the ordering process, Atelier Reya will indicate the accepted payment methods and any delivery restrictions.
The customer will receive, electronically, the General Terms and Conditions of Sale as well as the details of their order. They will have the opportunity to verify the details of their order, its total price, and to correct any errors before confirming their acceptance.
The order will only be registered once the customer has expressly accepted the General Terms and Conditions of Sale and confirmed the order. Payment instructions or links will only be provided after the customer has accepted the General Terms and Conditions of Sale.
Payment will be made via a secure payment link or by bank transfer from the customer.
Online Sale Orders:
It is the customer’s responsibility to select the item(s) and quantity(ies) they wish to order on the Website. Once chosen, items can be added to the shopping cart. Customers may continue shopping, add items (subject to availability), or proceed to checkout. Items can also be removed from the cart.
Customers validate the cart via guest checkout or their registered account, providing necessary information for processing and shipment. Atelier Reya will indicate accepted payment methods and any delivery restrictions at the start of the process.
Customers may review order details, total price, and personal information to correct any errors before confirming acceptance.
Orders are registered on the Website only after customers have expressly accepted the General Terms and Conditions of Sale by checking the designated box. Payment can only proceed once the box is checked. Clicking ‘place an order and pay’ places a firm order.
After payment, whether through Distance Selling or Online Sales, Atelier Reya will acknowledge receipt. This acknowledgment does not constitute order acceptance; verification of availability and fraud checks will be carried out.
The sale is final only after shipment confirmation is sent to the customer.
Atelier Reya reserves the right to refuse or cancel any order for legitimate and objective reasons. In case of cancellation after payment, the customer will be informed and refunded if applicable.
Item Prices: Prices displayed on the Website are in the selected currency and include applicable taxes unless otherwise stated.
Item Prices
The prices of items communicated by the Distance Selling Service and displayed on the Website are inclusive of all taxes in Euros, unless expressly stated otherwise when the order is placed by telephone, email, or on the Website.
Delivery is free for both online and distance selling. Import duties will be charged for distance selling orders delivered outside mainland France.
The price including VAT of each item the customer wishes to acquire, as well as any applicable import fees, will be communicated before validating the order, either via the Distance Selling Service or electronically on the Website.
In accordance with Article L.221-11 of the Consumer Code, the customer will receive written confirmation by email, at the latest upon delivery, detailing the price paid for each item and any applicable import fees.
Item prices are subject to change over time and may be modified without notice. These changes do not affect orders already placed and in progress.

No deposit is required for online sales.
Delivery
Atelier Reya will deliver the ordered items either by courier or express transport, depending on the delivery address.
For all Distance Sales or Website Sales, deliveries cannot be made to post office boxes.
When placing an order, the customer may specify a recipient other than themselves.
A signed proof of receipt from the recipient will be systematically required.
Items will be delivered to the address indicated when the order was placed, after full payment has been received. Delivery will take place no later than thirty (30) days from the day following the order, in accordance with Article L.216-1 of the Consumer Code.
Atelier Reya will make best efforts to comply with communicated deadlines, which are indicative and will not exceed the maximum period of thirty (30) days.
If the customer or recipient is absent at delivery, they will be notified of the unsuccessful attempt and are responsible for rescheduling delivery with the carrier.
Following multiple unsuccessful delivery attempts, or if the customer fails to reschedule, the items will be returned to Atelier Reya. The order will be cancelled and the customer refunded via the original payment method.
Delivery of the item will be accompanied by a certificate of authenticity.
The risk of loss or damage transfers to the customer or designated recipient when they take physical possession of the goods. Ownership transfers only upon full payment of the price.
Exchange (Distance Sales Only)
Without prejudice to the statutory right of withdrawal and applicable legal guarantees, Atelier Reya offers customers the possibility of exchanging delivered items only within the framework of Distance Sales. Items delivered through Online Sales cannot be exchanged; however, customers may exercise their statutory right of withdrawal and be refunded for the returned product, then place a new order.
For Distance Sales, customers retain the right to withdraw from the purchase under the terms described previously and obtain a refund. If the customer prefers to exchange the product, they may, within thirty (30) days of delivery:
Option 1: Proceed with the exchange remotely. The customer must return the delivered items in their original packaging, complete with boxes, accessories, certificate of authenticity, security seals, and the completed return form along with a copy of the invoice, using the prepaid return label provided by Atelier Reya. Any new delivery will only be made once Atelier Reya has received the returned items.
Option 2: Present the items in person at an Atelier Reya store where the initial transaction took place, with the delivered items in their original packaging, complete with all accessories, and accompanied by a copy of the invoice to proceed with the exchange.
Items returned incomplete, damaged, deteriorated, soiled, or in any other condition suggesting use beyond inspection will not be exchangeable and will be returned to the customer in the case of a remote exchange.
In the event of an exchange, the initial sale will be cancelled. Payment for the new sale will be offset against the amount of the previous sale, with any overpayment credited to the customer’s account for one year from the date of issue. Credit notes for overpayments will be issued by an Atelier Reya store and valid only at that store.
For exchanges via the Distance Selling Service, the new sale will be subject to the General Terms and Conditions of Sale in force at the time of the exchange.
Conformity - Warranty
The customer must ensure that the items delivered correspond to their order. If the delivered items do not conform to their order, they must inform Atelier Reya and return the items in their original packaging, complete and accompanied by a copy of the invoice.
Atelier Reya products are subject to legal warranty conditions. Atelier Reya is liable for defects in conformity under Articles L217-1 et seq. of the Consumer Code and for hidden defects under Articles 1641 to 1649 of the Civil Code.
The customer benefits from the legal guarantee of conformity, meaning goods must conform to the contract and criteria in Articles L217-4 and L217-5 of the Consumer Code, including description, type, quantity, quality, intended purpose, accessories, instructions, updates, and reasonably expected use.
The seller is not bound by public statements they could not reasonably know, that were corrected, or that could not influence the purchase. Customers cannot contest conformity for deviations explicitly informed and consented to.
Atelier Reya is liable for any lack of conformity present at delivery that appears within two years. Customers are exempt from providing proof of non-conformity within 24 months (12 months for second-hand items).
Customers may choose repair or replacement, or if impossible, a price reduction or termination of the contract. Repairs or replacements are at no cost and must be completed within 30 days. Repaired items gain a six-month extension of the guarantee. Replacement items trigger a new two-year guarantee.
Customers may request a price reduction or contract termination if compliance measures are refused, delayed over 30 days, cause significant inconvenience, or if the customer bears related costs. Minor non-conformities do not allow contract cancellation. Price reductions are proportional to the value difference.
Upon termination of the contract, items are returned to Atelier Reya at their expense and the customer is reimbursed using the original payment method within 14 days of receipt or proof of return.
Customers may also invoke the legal guarantee against hidden defects (Articles 1641-1648 of the Civil Code) within two years of discovering the defect. They may choose to cancel the sale and receive a refund, or keep the item with a partial refund. The guarantee covers all costs and potential damages caused by the defect.
In summary, under the legal guarantee of conformity, the customer benefits from a two-year action period, may choose repair or replacement (or price reduction/termination if repair is impossible or costly), is exempt from proving non-conformity within 24 months (12 months for second-hand items), and may also apply the hidden defects guarantee with the choice of contract termination or price reduction.

Any reproduction, in whole or in part, modification, distribution, or use of these trademarks, illustrations, designs, images, and logos, for any reason and on any medium whatsoever, without the express, prior written consent of Atelier Reya, is strictly prohibited. The same applies to any combination or conjunction with any other trademark, symbol, logo, or, more generally, any distinctive sign intended to form a composite logo. Any unauthorized use of any of these intellectual property rights may result in legal action against the customer.
Force Majeure
The performance by Atelier Reya of all or part of its obligations will be suspended in the event of the occurrence of a fortuitous event or force majeure which would hinder or delay its performance, in accordance with Article 1218 of the Civil Code. The following are considered as such, in particular, without this list being exhaustive: war, pandemics, riots, insurrection, social unrest, strikes of all kinds, and supply problems of Atelier Reya. Atelier Reya will inform the customer of any such unforeseen event or force majeure within seven (7) days of its occurrence. Should this suspension continue beyond fifteen (15) days, the customer will then have the option to cancel the order, and a refund will be issued within a reasonable timeframe, and at the latest within fourteen (14) days from the date the customer canceled the order. The refund will be issued using the same payment method as the original transaction.
Disputes - Applicable Law
These General Terms and Conditions of Sale are governed by and subject to French law. They are written in French. In the event that they are translated into one or more other languages, only the French text shall prevail in the event of a dispute. In the absence of an amicable solution or recourse to mediation, all disputes arising from the General Terms and Conditions of Sale will be submitted to the competent courts of Paris (France). In the event of a dispute arising from an order placed under Distance Selling or the delivery of ordered items, and following a prior written complaint by the customer to customer service dated less than one (1) year and which has remained unsuccessful, the customer may, if they wish, resort to any alternative dispute resolution method and in particular to a mediation procedure, which will attempt, independently and impartially, to reach an amicable resolution of the dispute. The client is free to accept or refuse recourse to mediation, and in the event of recourse to mediation, each party is free to accept or refuse the solution proposed by the mediator.
Specific Conditions for Personalized Items
Atelier Reya offers a complimentary personalization service (engraving or size adjustment of certain products) on a selection of items. These Specific Conditions apply to all Distance Sales of personalized items concluded remotely. All provisions of the General Terms and Conditions of Sale that are not amended by these Specific Conditions remain applicable.
Order procedure for Distance Sales or Online Sales: whether in the context of a Distance Sale or an Online Sale, the order of personalized items follows the procedures defined for standard orders. Personalized items are defined as any item modified at the client’s request to meet their expectations. Examples include engraved rings, pendants or bracelets, resized rings, bracelets or necklaces adjusted in length, and watch straps whose length has been altered. These personalized items will be indicated on the corresponding product pages.
For orders of personalized items placed at the express request of the client: in the context of a Distance Sale, explicit written validation (by email) from the client regarding the requested modifications will be required before processing. For an Online Sale, the desired modifications will appear in the shopping cart before the payment step.
Returns and exchanges of personalized items: due to their highly personalized nature according to the client’s specifications, personalized items cannot be returned, refunded under the right of withdrawal, or exchanged. The provisions relating to returns, withdrawal or exchanges do not apply to personalized items. Nevertheless, the client retains the legal guarantees provided in the General Terms and Conditions of Sale.
